The Transportation Department has responsibility for administration of transportation by motor carriers as provided by Neb. Rev. Stat. R.R.S. 1943, Sections 75-301 to 75-322.04 and 75-348 to 75-380, and the Rules and Regulations adopted by the Commission as provided by Section 75-110.

Intrastate
|
The Commission regulates the rates, routes and services of all carriers moving household goods and transporting passengers for hire within the state. It may grant or deny an application for a Certificate of Public Convenience and Necessity or Contract Carrier Permit and may revoke, cancel, suspend, or change any certificate or permit for violation of applicable Nebraska laws or rules and regulations.
Carriers wishing to operate as a household mover or passenger carrier in intrastate commerce must make application for operating authority with the Public Service Commission. After a 30-day protest period, the uncontested application will be set for modified procedure, while a protested application will be set for formal hearing. After hearing the evidence and reviewing the transcript, a majority vote of the Commissioners will determine whether an application is granted or denied. If granted, the carrier will file combined single limit liability insurance coverage, meet tariff requirements and purchase PSC license plates for each vehicle operated in intrastate transportation.

Rates and Services Division
|
The Nebraska Public Service Commission is responsible for establishing the rates and regulations governing common carriers in the movement of household goods and passengers in intrastate commerce. The Rates and Services Division administers the intrastate tariffs and investigates all rate applications and tariff abuses.
As a result of the preemption contained in the federal acts of 1994 and 1995, the Commission may establish, for motor carriers of property in intrastate commerce, voluntary tariff rules relating to uniform cargo liability, uniform bills of lading or receipts for property being transported, uniform cargo credit rules, cargo classification and mileage guides. A carrier citing the Commission's rules in its individual tariff must be a participant in these rules.
